Obama and Bloomberg Use December 14 to Promote Gun Control

Google "Organizing for Action" (OFA), supposedly a non-partisan, grassroots group, and you get www.barackobama.com.  Likewise, click on the preceding link, and it takes you to the Organizing for Action website.  Despite OFA's innocuous-sounding name, the Chicago-based group is an arm of the Obama political machine, the successor to a similar Obama store-front put together after his 2008 election, Organizing for America. Whatever the group's name happens to be at a given moment, fulfilling the president's goal of "fundamentally transforming America" remains its mission. 

On Monday, Obama's current operation sent an email to supporters urging them to hold events advocating gun control on December 14, the one-year anniversary of the murders at Sandy Hook Elementary School, in Newtown, Connecticut.

Meanwhile, Michael Bloomberg's euphemistically-named group, Mayors Against Illegal Guns, along with Moms Demand Action, are releasing a 60-second version and a 30-second version of a TV ad portraying a person approaching an elementary school with a duffel bag, as students observe a moment of silence for the victims who were killed at Sandy Hook Elementary.  The obvious implication is  that the gun control laws that one or both groups support could prevent the type of crime committed at Sandy Hook.

Concurrently, Vice-President Joe Biden sent an email encouraging organizers of the OFA events to center them on support for a "universal background checks" law that would prohibit private sales of firearms without a background check and for increasing penalties for illegal gun trafficking.

Dovetailing with the Bloomberg ads, Biden implied that imposing "universal checks" and increasing trafficking penalties would prevent terrible crimes like those committed at Sandy Hook; in the Aurora, Colorado, theater; in the Sikh temple in Oak Park, Wisconsin; and at Virginia Tech University.

Like so much of what underlies the gun prohibition movement, the premise behind Bloomberg's ad and Biden's message is simply not true.  In each of the crimes the gun control supporters point to, the guns involved were bought legally, from a firearm dealer, with a background check.  No trafficking was involved.  And the guns used in the Sandy Hook murders were stolen from their lawful owner, who was also murdered by the perpetrator.

Obama and Biden are additionally claiming that Obama's 23 executive actions, announced earlier this year, have helped "make sure our families and communities are safe."  But there's no evidence to support that claim.  Furthermore, even before the "actions" were announced, America's murder rate had fallen to lower than any time since 1963, and its total violent crime rate had fallen to lower than any time since 1970.

Obama and Bloomberg are pulling out the stops, knowing that support for gun control--which rose in the days after Sandy Hook--is waning.  Not only was the Obama gun control agenda defeated in the Senate last spring, a new CNN poll shows that support for gun control has dropped by six points since January, and a majority of Americans now oppose stricter gun laws.

For proponents of the Second Amendment, things are moving in the right direction. Yet the president, with the assistance of America's most meddlesome billionaire, remains determined to push his gun control agenda and will exploit any occasion, no matter how crassly, to promote it. It's going to be a long three years that will require your eternal vigilance and increased activism as we work to make Americans safer by ensuring enforcement of gun laws, by reforming our mental health system, by working to prevent the inevitable assaults on our liberty, and by electing pro-Second Amendment lawmakers to office in next year's elections.

Catholics Oppose Amnesty or Do They

This week, pro-amnesty Catholic organizations are organizing a pro-amnesty phone-in for Catholics who are in favor of amnesty for illegal aliens.  These organizations will be asking their supporters to call their Members of Congress and tell them that the vast majority of Catholics in America support giving illegal aliens legal status, work permits, and a pathway to citizenship.

The media also seizes on these reports of Catholics pushing Congress for amnesty to back up their claims that nearly all Catholics support amnesty for illegal aliens.  This simply isn't the case.

Polling conduced by Pulse Opinion Research shows that most Catholic Americans don't support amnesty and would rather focus on putting jobless Americans back to work. 

It is disappointing that the media continues to report that most Catholics support giving amnesty to illegal aliens.  Recent polling shows that this simply isn't the case.

 With 20 million Americans unable to find a full-time job, I personally find it repugnant that business lobbyists and some in Congress want to significantly increase the number of foreign job-seekers. How will the U.S. economy ever be expected to get back to full employment if American workers are constantly facing an immigration-fueled oversupply of labor? Don't we have a moral obligation to help America's jobless get back to work and not help other country's workers find employment in America?

 Pulse Opinion Research asked Catholic voters, "Congress is considering a bill to give work permits to an estimated 7 million illegal immigrant workers. Do you strongly support, somewhat support, somewhat oppose or strongly oppose the work permits?"

 44% strongly opposed this, while only 11% strongly supported. 21% somewhat opposed and another 21% somewhat opposed.

 Despite what a small minority of Catholics are saying, the rank and file of the Catholic Church are NOT behind legislation that gives work permits to 11 million illegal immigrants. If these illegal immigrants want to become Americans, then I say come through the front door not the back. This way they can be screened for infectious diseases. We are compassionate people but we must protect ourselves and our children. I’m not for amnesty and neither should you; this will put us in a direct nose dive economically. When they come here illegally they take jobs away from us. They will become slaves to big companies because they can hire them for a lower wage. Then instead of putting the money they make back into the American economy they send it back to their country, this will stimulate theirs not America’s.

Report: Affordable Care Act to Raise Premiums in Texas 

The Affordable Care Act will increase the average cost of insurance premiums, making health care less affordable for those Texans on whom the system financially depends, according to a report from a conservative think tank.

 The report, released Monday by the Texas Public Policy Foundation, says premiums for health insurance plans will increase for young, healthy Texans under the Affordable Care Act, also known as Obamacare. The health care law requires private insurers to cover essential health benefits and establishes a federal marketplace for insurers to sell coverage plans, among other requirements.  

The report concludes that premiums will be on average "significantly higher than coverage available on the individual market in Texas prior to the ACA." Armed Protesters Rally at Alamo Over Gun Restrictions

More than a thousand people, many sporting rifles and other long guns, turned out at the Alamo on Saturday for a protest over local, state and federal gun restrictions, according to organizers' estimates.

 The event focused mainly on a Texas law that prohibits the open carry of handguns, though it also referenced gun laws across the nation. The event was organized by Open Carry Texas, Come and Take it America and Carry Texas, according to C.J. Grisham, a spokesman for Open Carry Texas.

 Current Texas law allows owners of long guns and several other types of guns to openly carry, while handgun owners must conceal their weapons.

 Grisham said that while most attendees were from Texas, the rally also drew participants from as far away as Florida. Read More

Obamacare deductibles

Adam Weldzius, a nurse practitioner, considers himself better informed than most when it comes to the inner workings of health insurance. But even he wasn't prepared for the pocketbook hit he'll face next year under President Barack Obama's health care overhaul.

If the 33-year-old single father wants the same level of coverage next year as what he has now with the same insurer and the same network of doctors and hospitals, his monthly premium of $233 will more than double. If he wants to keep his monthly payments in check, the Carpentersville resident is looking at an annual deductible for himself and his 7-year-old daughter of $12,700, a more than threefold increase from $3,500 today.

"I believe everybody should be able to have health insurance, but at the same time, I'm being penalized. And for what?" said Weldzius, who is not offered insurance through his employer. "For someone who's always had insurance, who's always taken care of myself, now I have to change my plan?"

Many Illinoisans buying health coverage on their own next year will face a similar dilemma spurred by the health care overhaul: pay higher monthly insurance premiums or run the risk of having to shell out thousands more in deductibles for health care if they get sick.

To promote the Oct. 1 debut of the exchanges, the online marketplaces where consumers can shop and buy insurance, Obama administration and Illinois officials touted the lower-than-expected monthly premiums that would make insurance more affordable for millions of Americans. But a Tribune analysis shows that 21 of the 22 lowest-priced plans offered on the Illinois health insurance exchange for Cook County have annual deductibles of more than $4,000 for an individual and $8,000 for family coverage. Border Patrol Ordered to Stand Down

The Vice President of the National Border Patrol Council, the union that represents the nation's Border Patrol agents, Shawn Moran, has told Breitbart News that agents are being ordered to stand down and end any pursuit of drug smugglers, human smugglers, and illegal aliens. Moran said the reasons given by the administration are budgetary concerns and to ensure agents aren't working long shifts.

"It doesn't matter whether it's drugs, bodies, or how large the group is, our agents are being ordered to stand down by Border Patrol management," said Moran. "I have received reports from our agents in every single sector from San Diego to the Rio Grande Valley in Texas that they are receiving these orders."

Moran said agents aren't being relieved of their posts, but instead, they're being told that someone else is taking their place, but no agents have seen that take place. Moran said, while Border Patrol management cite budgetary concerns, the agency has one of its largest budgets ever, but agents haven't seen any benefits from the increased budgets.

"They are placing the budgetary concerns before the security of our border," Moran said. "Groups that are outside of human trafficking, human smuggling, and drug smuggling are going to exploit these stand down orders as well, not only cartels but illegal aliens from nations that are tied to terrorism."

What is a Health Insurance Marketplace and Who Should Care

What is a health insurance marketplace?

Also known as health insurance exchanges, a health insurance marketplace is part of the Affordable Care Act (ACA), better known as healthcare reform.

The marketplace is an online store where people can shop for health insurance, compare the various plans, and enroll in a plan.

Starting January 1, 2014, people who do not have health insurance must either enroll in a health insurance plan or pay a fee.

The Fee, or tax penalty, will increase each year the individual does not enroll in a health insurance plan. The fee starts in 2014 at 1% of annual income or $95 per adult ($47.50 per child), whichever is higher. That penalty will be paid on your 2014 tax return, due April 2015.

Obamacare Software Glitch Providing Wrong Prices

(Breitbart) - An Obamacare software glitch is now incorrectly tabulating how much people must pay for health insurance, according to a report from the Wall Street Journal.

“There’s a blanket acknowledgment that rates are being calculated incorrectly,” a senior health insurance executive told the WSJ. “Our tech and operations people are very concerned about the problems they’re seeing and the potential of them to stick around.”

Government officials, however, say they are not worried and promised the Obamacare insurance exchanges will be ready to go on October 1. “We continue working with [insurers] and we are confident that on Oct. 1, consumers will see accurate premium costs, including tax credits,” said Medicare spokesperson Brian Cook.

The group responsible for building the calculator application, CGI Group Inc., bagged an $88 million taxpayer-funded government contract, the largest of any contractor, reports the WSJ.

Late Wednesday, Obama officials admitted that the Obamacare exchanges pose so many “cybersecurity threats” that it is instituting a new “rapid response mechanism,” a call center to field consumer complaints. It has also produced a publication on how to “Protect Yourself From Fraud In The Health Insurance Marketplace.”

The Federal Trade Commission says it expects fraudsters and scam artists to use Obamacare to target victims. Analysts say Obamacare is primed and ready for massive online identity theft by con artists.

“There are people licking their chops and saying, ‘A sucker is born every minute,’”said Health Access California director Elizabeth Abbott.

Obama Slashes Pay Raises for Military

President Obama has told Congress he will cap next year's pay raise for U.S. military personnel at 1 percent instead of boosting pay by 1.8 percent as called for by a federal law.

The president's move will negatively impact American combat troops scheduled to remain in Afghanistan through 2014.

The federal law says military pay raises must be based on the Employment Cost Index compiled by the Bureau of Labor Statistics, which ties military raises to private sector pay growth. Under that formula, military personnel should be getting a 1.8 percent pay raise beginning in January 2014, CNS News reported.

But the law also states that the president can inform Congress of an alternative pay adjustment "if because of national emergency or serious economic conditions affecting the general welfare, the president considers the pay adjustment which would otherwise be required by this section in any year to be inappropriate."

Obama wrote to congressional leaders: "I am strongly committed to supporting our uniformed service members, who have made such great contributions to our nation over the past decade of war. As our country continues to recover from serious economic conditions affecting the general welfare, however, we must maintain efforts to keep our nation on a sustainable fiscal course."

He also asserted that his decision "will not materially affect the federal government's ability to attract and retain well-qualified members" of the military.

The House passed a bill in July authorizing the 1.8 percent raise, but the Senate has set the raise at 1 percent as recommended by Obama.

Military pay rose 1.7 percent this year and 1.6 percent in 2012.

Retired Air Force Col. Mike Hayden, director of government relations for the Military Officers Association of America (MOAA), calculated that the reduced pay raise could cost an officer with 10 years of service about $52 a month next year, or $8,000 over the remaining years of his or her career. It would also cost a service member $20,000 in retirement pay.

Hayden wrote on the MOAA website: "Over the past 12 years, Congress worked hard to fix the 13.5 percent pay gap (and resulting retention problems) caused by repeatedly capping military raises below private-sector pay growth in the 1980s and 1990s.

"History has shown that once Congress starts accepting proposals to cap military pay below private-sector growth, pay caps continue until they have weakened retention and readiness."

This war hawk pushing Obama to bomb Syria

NEW YORK – U.N. Ambassador Samantha Power is a driving force urging President Obama to strike in Syria, according to informed Middle Eastern diplomats.

Power was notably absent during an urgent U.N. Security Council meeting last month concerning Syria’s alleged use of chemical weapons.

Her name barely pops up in news media coverage of the crisis in Syria.

Power’s most visible reaction to events in Syria so far has been a Tweet accusing Syrian President Bashar al-Assad of using chemical weapons.

Yet behind the scenes, Power is a central player at pushing Obama to launch a military campaign in Syria, the diplomats told WND.

The diplomats said Power has been working with Syrian foes Turkey and Saudi Arabia as well as with key Syrian opposition figures in trying to convince the White House to act sooner in Syria.

The diplomats say that last week, Power recommended Obama strike in Syria without first consulting Congress, a move from which the president clearly seems to have backed away.

Power’s central involvement may be telling.

As WND has reported, Power served on the advisory board that created the “Responsibility to Protect,” or R2P doctrine that would be used to justify any U.S. strikes in Syria.

The U.S.-NATO bombings in Libya in 2011 have been widely regarded as a test of R2P.

Cruz still hopes to defund Obamacare

Sen. Ted Cruz has doubled down on his long shot bid to defund Obamacare, even though Senate Democrats are highly unlikely to approve a short-term spending deal this September that impugns President Obama's signature domestic achievement.

In an interview that aired Sunday, the Texas Republican admitted he lacks the votes in the Senate needed to force a government shutdown, but he said a "grass-roots tsunami" of opposition to the Affordable Care Act over the next few weeks could change that.

"And at that point, Republicans have to do something we haven't done in a long time: stand up and win the argument," he told CNN's "State of the Union." "We have to stand up and say no."

Democrats and the Obama administration say they are committed to the health care law and that it is already showing signs of promise, with select states reporting proposed insurance rates that are lower than expected.

The administration is working feverishly to set up state-based health exchanges, where qualified consumers without employer-based health coverage may buy insurance through the help of government subsidies, in time for the start of open enrollment on Oct. 1.

LEVIN says FEDS MUST BE STOPPED BEFORE AMERICA IS LOST

John Boehner wants the president to arbitrarily delay the ObamaCare mandate on employers

At a weekly press on July 14, 2013, House Speaker John Boehner (R-OH) said it’s absolutely unfair and indefensible for the president to arbitrarily delay the ObamaCare mandate on employers, while maintaining the law’s penalty on hardworking American families.  Following are Speaker Boehner’s remarks:

 “Our economy continues to struggle with slow economic growth, high unemployment, and stagnant wages.  This is the ‘new normal’ under President Obama’s leadership.

“Republicans have a plan to strengthen our economy, create new jobs, and make life work for more Americans.  We’ve been talking about our jobs plan all year, it’s here, and we’re going to continue to focus on jobs. 

“We’re fighting to make college more affordable for students and their families.  We’ll pass another bill this week to expand American energy production.  And we remain committed to repealing ObamaCare.

“Listen, ObamaCare is raising costs, it’s making it harder for small businesses to hire, and frankly, with last week’s announcement, it’s wide open to fraud and abuse.  In short, it’s a train wreck.  And even the administration knows that this law is unworkable.

“The president has delayed ObamaCare’s employer mandate, but hasn’t delayed the mandate on individuals or families.  I think it’s unfair and indefensible.

“If you’re a software company making billions of dollars in profits, you’re exempt from ObamaCare next year.  But if you’re a 28 year-old struggling to pay off your student loans, you’re not.  If you’re a big bank or a financial company, you don’t have to comply with ObamCare next year.  But if you’re a single parent trying to make ends meet, there’s no exemption for you.  And if you’re a big government contractor, you don’t have to comply with the ObamaCare mandate next year.  But if you’re a family of four in Ohio, you do – or you get taxed.

“Listen, is it fair for the president to give American businesses an exemption from the health law’s mandates, without giving the same break to individuals and families across the country?  Hell no it isn’t.

“Next week the House will vote to delay both the employer mandate and the individual mandate.  I believe it’s unfair to protect big businesses from ObamaCare, but not individuals and families.”

President Obama’s Climate Action Plan

On Tuesday June 25, 2013 Obama put out this statement on his plan to cut Carbon Pollution. When the coal mines shut down what are the kids of these workers going to do when they get hungry because their parents don’t have a job? What happens when people can’t afford the electricity because of this? This is just another way to grow government and make people depend on Government. This is going to drive people to crime just to put food on the table for their kids. I want to know just who Obama thinks he is? He's not a king, he's not a dictator yet; and he damn sure not God. Texas becomes first US state to ban warrantless email snooping

Texas has become the first US state to ban email snooping without a warrant.

Governor Rick Perry signed the new privacy bill - HB 2268 - into law on Friday. It went into effect immediately.

The bill enacts a law that sets Texas residents apart from the other 49 states by protecting them from state and local law enforcement surveillance carried out without a warrant.

The portion of the bill that pertains to privacy was written by 29-year-old freshman Republican legislator Jonathan Stickland, who represents an area between Dallas and Fort Worth.

Stickland told the Star-Telegram that he's fighting for ideals that all US citizens can get behind - a sentiment the newspaper applauded:

“Despite the many differences between Tea Party Republicans like Stickland and the most liberal weenies you might find in Austin, there also tend to be some similarities.

"One of them is that whatever government does, it should do in the open. There can be arguments over exactly what government transparency is, but both liberals and Tea Partiers tend to be for it."

As Ars Technica's Cyrus Farivar points out, the Electronic Communications Privacy Act (ECPA) requires federal law enforcement to get a warrant only to access email that hasn't yet been opened by its recipient.

After it's open, sitting around in an inbox, it's been fair game. Ditto if the email has been left unopened in an inbox for 180 days.

The Department of Justice for the first time acknowledged in March that maintaining different legal standards for finely aged email is an outdated notion, supporting revisions to ECPA.

In the meantime, as we wait for revisions to ECPA, the residents of 49 US states are subject to a lower level of privacy than the Lone Star State.

That's a nickname granted to Texas, some say, to signify that it's a former independent republic, as well as a reminder of the state's struggle for independence from Mexico.

Let's hope that 49 other states follow the privacy path pointed out by that star.

The IRS and its 46 new powers to enforce ObamaCare

The power granted to the IRS to enforce ObamaCare’s mandates, taxes, penalties, reporting, and other requirements is unprecedented. Based upon Government Accountability Office data, we count 46 new responsibilities assigned to the IRS under the health law.1

IRS officials have acknowledged the huge problems these major new responsibilities will create for the agency. On March 5, 2013, an official from the Treasury Department’s Inspector General for Tax Administration, J. Russell George, testified before the House Appropriations Committee. Mr. George was asked about the tax implications of ObamaCare.

“It is unprecedented in recent history, the amount of responsibility the IRS is being given in an area that most people don’t think of as an IRS function,” George said. Americans, he added, will have more questions about their taxes because of health care penalties or credits, flooding already busy call-in and walk-in tax help centers. “This is going to lead to problems, sir,” he testified.

Many people are especially concerned about assigning an unprecedented number of major new responsibilities to implement ObamaCare to an agency whose primary task is collecting revenues to fund the Federal government.

Two federal judges in separate cases entered orders permanently barring Marvin Binion Sr., his son Marvin Binion II, Binion Sr.’s ex-wife Tonya Hubbard and her firm Universal Tax Service LLC from preparing tax returns for others, the Justice Department announced today.  The civil injunction orders, to which all defendants consented, were signed by Judge Roger W. Titus and Judge Alexander Williams Jr., of the U.S. District Court for the District of Maryland.
            
The two government complaints, one against the Binions and one against Hubbard and her firm, alleged that the defendants prepared fraudulent tax returns for customers containing bogus deductions for items like charitable contributions, unreimbursed employee business expenses and other miscellaneous expenses.  The lawsuits also alleged that Hubbard, Universal Tax Service LLC and the Binions violated federal law by not signing the returns they prepared for customers and by not placing IRS preparer identification numbers on the returns.  All tax preparers are required to place an IRS-issued tax preparer identification number on every federal income tax return they prepare for a customer.

According to the complaints the defendants prepared customer returns using commercial tax software, placed the returns in postage-paid pre-addressed envelopes and instructed customers to sign and mail the returns to the IRS on their own.  The suits alleged that defendants did this to hide from the IRS their role in preparing the returns.

The government alleged that Hubbard and the Binions charged customers a return-preparation fee of $300 and that the Binions may have earned as much as $30,000 per day preparing fraudulent returns.

The Internal Revenue Service has listed tax-preparer fraud as one of the “Dirty Dozen” tax scams.  The Justice Department has obtained injunctions against hundreds of tax-return preparers and tax-fraud promoters in the past ten years. Foreign vote count firm expands U. S. reach

Last week, WND exposed how SCYTL recently acquired the software division of a non-profit election organization tied to George Soros’ Open Society Institute.

SCYTL said it is purchasing the software division of Gov2U, described as a non-profit organization dedicated to developing and promoting the use of technology in the fields of governance and democracy.

A SCYTL press release says: “Gov2U created its software division in 2004 and, since then, it has developed a wide array of innovative award-winning eDemocracy solutions that have been implemented in multiple countries across Europe, Africa and America at the local, regional and federal government levels.”

The Spain-based company says the “main purpose of these tools is to engage citizens in participatory processes through the use of online and offline platforms, bringing more transparency and legitimacy to decision-making processes.”

Gov4U is currently partnered with Soros’ Open Society to support and develop a group called the Declaration on Parliamentary Openness.

The group runs a website, OpeningParliament.org, which says it is a forum “intended to help connect the world’s civic organizations engaged in monitoring, supporting and opening up their countries’ parliaments and legislative institutions.”

Gov4U, meanwhile, has eight partners of its own listed on its website, including the Soros-funded and partnered National Democratic Institute, or NDI.

Aside from receiving financial support for Soros, NDI has co-hosted scores of events along with Soros’ Open Society. The two groups work closely together.

NDI and the Open Society, for example, worked together to push for electoral and legislative reform in Romania.

NDI boasts that with Open Society Institute funds it conducted a political leadership training series for Romanian activists to “bring tangible improvements to their communities.”

NDI describes itself as a nonprofit, nonpartisan, nongovernmental organization working to establish and strengthen political and civic organizations, safeguard elections and promote citizen participation, openness and accountability in government.

NDI previously stated it was founded to draw on the traditions of the U.S. Democratic Party.

WND found that NDI is also listed as the only U.S.-associated organization of Socialists International, the world’s largest socialist umbrella group.

NDI was originally created by the federally funded National Endowment for Democracy, or NED, which itself founded joint NDI projects with the Open Society. Another NDI financial backer is the United States Agency for International Development, USAID.

Texas Announces Plans to Eliminate CSCOPE Curriculum Program from Its Schools

It appears that the Texas has managed to remove the controversial curriculum management program called CSCOPE from the state’s educational system. Texas State Senator Dan Patrick announced the move on Monday morning via a press release and press conference.

“I’m very pleased to announce this morning that the era of CSCOPE lesson plans has come to an end,” he said.

Senator Patrick closed his remarks by thanking all parents who got involved in their children’s education and the state’s legislators who worked together to remove the controversial program from the education system.

In the past, CSCOPE had been linked to lessons such as asking if the Boston Tea Party was an act of terrorism.

Obamacare: Taxpayers Must Report Personal Health ID Info to IRS

WASHINGTON, D.C. – When Obamacare’s individual mandate takes effect in 2014, all Americans who file income tax returns must complete an additional IRS tax form. The new form will require disclosure of a taxpayer’s personal identifying health information in order to determine compliance with the Affordable Care Act’s individual mandate.

As confirmed by IRS testimony to the tax-writing House Committee on Ways and Means, “taxpayers will file their tax returns reporting their health insurance coverage, and/or making a payment”.

So why will the Obama IRS require your personal identifying health information?

 

Simply put, there is no way for the IRS to enforce Obamacare’s individual mandate without such an invasive reporting scheme. Every January, health insurance companies across America will send out tax documents to each insured individual. This tax document—a copy of which will be furnished to the IRS—must contain sufficient information for taxpayers to prove that they purchased qualifying health insurance under Obamacare.

 

This new tax information document must, at a minimum, contain: the name and health insurance identification number of the taxpayer; the name and tax identification number of the health insurance company; the number of months the taxpayer was covered by this insurance plan; and whether or not the plan was purchased in one of Obamacare’s “exchanges.”

This will involve millions of new tax documents landing in mailboxes across America every January, along with the usual raft of W-2s, 1099s, and 1098s. At tax time, the 140 million families who file a tax return will have to get acquainted with a brand new tax filing form. Six million of these families will end up paying Obamacare’s individual mandate non-compliance tax penalty.

 

As a service to the public, Americans for Tax Reform has released a projected version of this tax form to help families and tax specialists prepare for this additional filing requirement. Taxpayers may view the projected IRS form. On the form, lines 3-4 show where taxpayers will disclose their personal health ID information.

How This President Operates

Oklahoma freshman Rep. Jim Bridenstine told The Daily Caller that he hasn’t witnessed normal congressional procedure since he took office in January.

“I’ve been here a month and a half, so, interestingly, I have not seen regular order since I’ve been here,” Bridestine told TheDC’s Ginni Thomas. “Everything is an emergency. Whether it’s raising the debt limit, which we did, which I voted against; whether it’s emergency relief for the Hurricane Sandy victims; whether its the National Flood Insurance Program; whether its the Violence Against Women Act. No matter what it is we are voting on, there is no regular order, there is no committee process that I have seen whereby these bills come up. The Senate passes it and we bring it to the floor and vote on it. Getting back to regular order is what we need to do.”

“As a freshman, I’d like to see how regular order works, instead of making everything an emergency that has to be voted on right now” he added. “It seems like we are going from catastrophe to catastrophe, and that’s really how this president operates.”

Taxing to Death the Firearms Industry

If you can’t ban it, tax it into being unattainable. As efforts to reinstate a federal ban on modern sporting rifles at the federal level fail to gain traction, lawmakers on Capitol Hill are looking for another option to get their gun control goals fulfilled with a little help from the IRS.

The proposals range from the modest — a proposed 5 percent tax in New Jersey — to the steep — a proposed 50 percent ammo tax in Maryland. The bills follow efforts to ban assault weapons and high-capacity magazines and expand background checks, measures that have had mixed success at the state level.

The taxes — much like so-called “sin taxes,” like those on cigarettes — serve a dual purpose. They can deter buyers, while using the extra revenue for favored programs. In this case, the sponsors want to direct the money toward mental health services, police training and victims’ treatment.

But firearms groups say a “sin tax” on firearms wrongly punishes law-abiding gun owners.

“If anything, gun owners ought to be getting a tax rebate for helping reduce crime,” said Lawrence Keane, senior vice president and general counsel for the National Shooting Sports Foundation.

COURT TO DHS: HAND OVER AMNESTY RECORDS

A federal court ruled the Obama administration must turn over records related to its policy of suspending some deportations of illegal aliens, which critics have called “stealth amnesty.”

The Department of Homeland Security violated the Freedom of Information Act by failing to hand over relevant records to the D.C. watchdog group Judicial Watch, ruled Judge Colleen Kollar-Kotelly of the U.S. District Court for the District of Columbia Feb. 28.

Judicial Watch said documents it previously uncovered show DHS officials misled Congress and the public about the scope of changes in its immigration enforcement policy.

The new policy gave wide latitude to local immigration officials to dismiss illegal alien deportation cases, including the dismissal of charges against illegals convicted of violent crimes.

“This ruling shows the Obama administration is willing to go to any extent – including gaming the courts – to continue stonewalling the full story of its lawless release of illegal aliens,” stated Judicial Watch President Tom Fitton.

“Now, with the prison floodgates being thrown open to illegal aliens under the phony pretense of abiding by sequester cuts, it is more important than ever that Obama’s hand be revealed,” he said.

The policy, implemented by Immigration and Customs Enforcement, or ICE, led to a reduction of the deportation docket in Houston, Texas, by dismissing pending enforcement proceedings against illegal aliens DHS claimed did not have serious criminal records.

Judicial Watch subsequently uncovered records showing that deportation cases were dismissed against illegal aliens who had committed serious felonies.

The litigation has become more significant, Judicial Watch pointed out, with the Obama administration’s large-scale suspension of deportations and the release of thousands of criminal illegal aliens due to alleged sequester budget cuts.

Since mid-February, the Obama administration has released from jail more than 2,000 illegal aliens facing deportation, the Associated Press reported. The administration reportedly plans to release 3,000 more this month.

Judicial Watch filed its original FOIA request with DHS in August 2010 and a subsequent lawsuit in March 2011 after the department refused to release the requested records.

In January 2012, the U.S. District Court denied a DHS motion to dismiss the case in part. The court chastised the agency for its inadequate explanations and gave it a final opportunity to establish the applicability of certain privileges in withholding the information.

In its Feb. 28 decision, the District Court ruled DHS had continued to improperly withhold a substantial number of documents under the “attorney-client” and attorney “work-product” privileges.

The court declared that each of the documents “appears to concern nothing more than the implementation of an agency policy.”

Withholding the documents, the court said, runs counter to the D.C. Circuit’s earlier admonition that a government attorney’s advice on political, strategic or policy issues is not shielded from disclosure by the attorney-client privilege.

The Texas Self-Sufficiency Act directs the Governor, Lieutenant Governor, the Speaker of the Texas House, and the Comptroller to name a committee of made up of legislators, budget experts and citizens from the non-profit sector to analyze not only our state's dependence on federal funds, but the impact of federal funding on Texas' economy. "Speaker Straus should be commended for naming a House interim committee on sequestration. However, we must expand on this work. My district in South East Texas, for example, has a higher proportion of seniors compared to the state overall percentage. What would happen in the event the Federal Government eliminated the funds normally allocated to them? In the current economic climate, exacerbated by out of control spending in Washington, Texas needs to study possible responses to Federal financial turmoil, and our readiness to adjust to such an event. Texans must govern Texas and Texans need to be concerned about Texas."

Senate Deal Keeps Most Tax Cuts

The White House and Mitch McConnell have reached a tentative deal early New Year's Day.

The measure would raise taxes by about $600 billion over 10 years and delay for two months across-the-board spending cuts otherwise set to begin slashing the budgets of the Pentagon and numerous domestic agencies.

Highlights:

  • Income tax rates: Extends tax cuts on incomes up to $400,000 for individuals, $450,000 for couples. Earnings above those amounts would be taxed at a rate of 39.6%, up from the current 35%. Extends Clinton-era caps on itemized deductions and the phase-out of the personal exemption for individuals making more than $250,000 and couples earning more than $300,000.
  • Estate tax: Estates would be taxed at a top rate of 40%, with the first $5 million in value exempted for individual estates and $10 million for family estates. In 2012, such estates were subject to a top rate of 35%.
  • Capital gains, dividends: Taxes on capital gains and dividend income exceeding $400,000 for individuals and $450,000 for families would increase from 15% to 20%.
  • Alternative minimum tax: Permanently addresses the alternative minimum tax and indexes it for inflation to prevent nearly 30 million middle- and upper-middle income taxpayers from being hit with higher tax bills averaging almost $3,000.
  • Other tax changes: Extends for five years Obama-sought expansions of the child tax credit, earned income tax credit, and an up to $2,500 tax credit for college tuition.
  • Unemployment benefits: Extends jobless benefits for the long-term unemployed for one year.
  • Cuts in Medicare reimbursements to doctors: Blocks a 27% cut in Medicare payments to doctors for one year. The cut is the product of an obsolete 1997 budget formula.
  • Social Security payroll tax cut: Allows a 2-percentage point cut in the payroll tax first enacted two years ago to lapse, which restores the payroll tax to 6.2%.
  • Across-the-board cuts: Delays for two months $109 billion worth of across-the-board spending cuts set to start striking the Pentagon and domestic agencies this week. Cost of $24 billion is divided between spending cuts and new revenues from rules changes on converting traditional individual retirement accounts into Roth IRAs.

Congress froze all federal salaries in 2011, and this September, extended that pay freeze until April of 2013.  President Obama recently issued an executive order that would raise federal salaries as soon as the authority for current government spending expires – April 1, 2013. Salaries for Members of Congress would rise roughly 0.5%.

I find it extremely disappointing and discouraging that while businesses and families are facing a tax hike, President Obama believes that federal government workers deserve a pay raise. That is not right. We need to be cutting spending—not increasing it on government salaries. When it comes time to reauthorize government spending, I will work to keep the current pay freeze in place and stop the President’s executive order from taking effect.

Rick Perry Says Obamacare Won't Be Successful

Obamacare doesn’t have much of a chance of working because of the wariness of states over the creation of health insurance exchanges, according to Texas Gov. Rick Perry.

“The exchanges are not going to work because states are wise enough not to go into a relationship when you don’t know what the rules are. You don’t know what the cost is going to be," Perry told Forbes magazine.

States have until Friday to decide whether to create their own health insurance exchanges that will help people learn about how and where to buy insurance. The federal government will step in and run exchanges for states that opt out of creating their own.

“The idea that you’ve got a state instituted exchange, but it has to be federally approved. So the fact is the federal government’s going to have to run these. And they don’t have the expertise, nor do they have the money,’’ Perry said.

Perry, who made an unsuccessful bid for the Republican presidential nomination this year, said he believes “wise governors and wise legislatures will say, ‘No, thank you.’

“Medicaid is a broken system. And the idea that we would expand and put more money and more people into a broken system is not unlike putting another 1,000 people on the Titanic. You know how this is going to turn out. And it’s going to be a disaster.’’

Perry said states should be given “the opportunity to innovate, to put in the programs that best serve their citizens . . .

“Bobby Jindal, one of the brightest innovators in the country. Rick Scott over in Florida, who spent his lifetime in health care. And a host of other governors, hopefully Democrat and Republican governors, will put ideas forward, put concepts forward, try them out in their states.’’

A former Navy chaplain who was forced out of the service for praying in Jesus' name while in uniform believes the GOP will continue to lose until it selects candidates who can win the support of evangelical Christians.

In the wake of the Republican Party's showing in the 2012 election, former Navy chaplain Gordon Klingenschmitt sees at least a couple of silver linings: the House remained in Republican control, and the GOP expanded its advantage in governorships.

But when it comes to the presidential stakes, Klingenschmitt contends that the Romney defeat proves once again that GOP "establishment" candidates have proven to be disasters.

"When Republicans choose social conservatives, they win; and when Republicans choose people like Mitt Romney or John McCain -- who are social moderates who run in the primaries against the church vote -- yeah, they may win the primary, but then they lose the general election because the church does not show up to support them," he expresses.

Still, Klingenschmitt says he is encouraged by the strong crop of GOP governors and other conservatives who appear to be the future of the Republican Party, including Mike Pence -- a former five-term U.S. congressman who on Tuesday won the governor's seat in Indiana. He takes office in January.

"Mike Pence would make a great presidential candidate in four years," he tells OneNewsNow. "Jim DeMint from South Carolina is not running again for the Senate in four years, so he'll have nothing to do but run for president. I think he ought to do that."

But Klingenschmitt, who runs The Pray In Jesus Name Project, says ultimately Christians must remember that the government run by people is not the eternal government.

"Jesus Christ is still King of Kings, he's still Lord of Lords," he shares. "We can have faith in him, and we can stand up against the persecution that is going to continue from the Obama administration."

Oklahoma Open Carry Law Goes Into Effect Nov. 1

 

The Oklahoma Open Carry law goes into effect on Nov. 1. According to the Oklahoma Open Carry Association (OKOCA), the law means that: as of that date, “…it will be legal to openly carry a handgun in the State of Oklahoma. This means that any person with a valid handgun license issued by the Oklahoma State Bureau of Investigation has the option to conceal or open carry their handgun. Open carry means that the firearm is carried in a manner that it is clearly visible to others, such as in an outside the waistband holster worn on a belt or in a shoulder holster that is worn on the outside of a shirt, blouse, vest, or jacket.”

Abuse in the Food Stamp Program

At the end of each month, the U.S. Department of Agriculture (USDA) releases a report on how many people take part in the Supplemental Nutrition Assistance Program (SNAP).  SNAP enrollment—formerly known as the food stamp program—has ballooned to more than 46 million participants. That is one in seven Americans. This growth in food stamps is partly because of the state of our economy – under President Obama, we had 42 consecutive months of unemployment above 8%.  The growth in food stamps has also far outpaced the economic downturn, in part, because the Obama Administration remains opposed to closing loopholes for program eligibility like those outlined in this Government Accountability Office (GAO) report.

SNAP is a valuable program for people who have fallen on hard times and need help feeding their families while they get back on their feet.  However, government benefits must be reserved specifically for our most vulnerable citizens. I’m working to stop abuse and close loopholes in this program. We must ensure that taxpayer dollars are only going to those truly in need of assistance. Fraud Scheme Supplied Over 3,500 Missouri Driver’s Licenses to Illegal Aliens

Federal prosecutors announced that 14 defendants are accused of running a fraud scheme that supplied more than 3,500 Missouri driver’s licenses to illegal aliens across the nation. The scheme, which sought licenses from a St. Joseph, Missouri facility between November 2009 and January 2012, allegedly made more than $5 million.

Four defendants have pleaded or are scheduled to plead guilty in federal court for their roles in the scheme, which involved supplying illegal aliens with fraudulent birth certificates and Social Security cards and helping them through the license acquisition process.

Four members of the Vanvacter/Gonzalez family admitted coaching illegal aliens to: memorize information on real birth certificates and Social Security cards; match signatures; and answer questions that employees could ask about the documents. The scheme also involved accompanying illegal aliens to the license office disguised as translators. The defendants – all citizens or legal residents -- each face up to five years in federal prison and a fine of up to $250,000.

An illegal-alien defendant in the case, Ranfe Adaias Hernandez-Flores, is charged with two counts of bringing in and harboring illegal aliens and one count of defrauding the United States. He is expected to be arraigned next month along with other illegal-alien and citizen defendants.

Just a few weeks ago, federal prosecutors announced the indictment of two other illegal aliens in a separate document fraud case that helped more than 100 illegal aliens get licenses from the same office in St. Joseph.

Romney and Ryan Medicare overview

President Obama has had three years in office, during which time he has attacked every serious proposal to preserve and strengthen America’s entitlement programs while enacting cuts to Medicare and putting in place a bureaucratic board that one day may ration the care available through the program. Mitt Romney has laid out the approach he would take to modernizing America’s entitlement programs, guaranteeing their continued vitality for future generations. Mitt’s proposals would not affect today’s seniors or those nearing retirement, and they would not raise taxes. But he proposes that tomorrow’s Medicare should give beneficiaries a generous defined contribution, or “premium support,” and allow them to choose between private plans and traditional Medicare.

Mitt’s plan honors commitments to current seniors while giving the next generation an improved program that offers the freedom to choose what their coverage under Medicare should look like. Instead of paying providers directly for medical services, the government’s role will be to help future seniors pay for an insurance option that provides coverage at least as good as today’s Medicare, and to offer traditional Medicare as one of the insurance options that seniors can choose. With insurers competing against each other to provide the best value to customers, efficiency and quality will improve and costs will decline. Mitt will enforce the second Amendment

As the Supreme Court recently reaffirmed, the Second Amendment protects one of the American people’s most basic and fundamental individual rights: “the Right to Keep and Bear Arms.” The Second Amendment is essential to the functioning of our free society. Mitt strongly supports the right of all law-abiding Americans to exercise their constitutionally protected right to own firearms and to use them for lawful purposes, including hunting, recreational shooting, self-defense, and the protection of family and property.

Like the majority of Americans, Mitt does not believe that the United States needs additional laws that restrict the Second Amendment right to keep and bear arms. He believes in the safe and responsible ownership and use of firearms and the right to lawfully manufacture and sell firearms and ammunition. He also recognizes the extraordinary number of jobs and other economic benefits that are produced by hunting, recreational shooting, and the firearms and ammunition industry, not the least of which is to fund wildlife and habitat conservation.

Mitt will enforce the laws already on the books and punish, to the fullest extent of the law, criminals who misuse firearms to commit crimes. But he does not support adding more laws and regulations that do nothing more than burden law-abiding citizens while being ignored by criminals. Mitt will also provide law enforcement with the proper and effective resources they need to deter, apprehend, and punish criminals.

As governor of Massachusetts, Mitt was proud to support legislation that expanded the rights of gun owners. He worked hard to advance the ability of law-abiding citizens to purchase and own firearms, while opposing liberal desires to create bureaucracy intended to burden gun owners and sportsmen. As governor, he also designated May 7th as “The Right to Bear Arms Day” in Massachusetts to honor law-abiding citizens and their right to “use firearms in defense of their families, persons, and property for all lawful purposes, including common defense.”

As president, Mitt will work to expand and enhance access and opportunities for Americans to hunt and shoot. He also will defend the right of individuals to protect their families, homes, and property, and he will fight the battle on all fronts to protect and promote the Second Amendment

ObamaCare was ruled constitutional Thursday, June 28, 2012. And yes, it’s still difficult to let that fact settle in. But today is the 4th of July. Today is our Independence Day. As you celebrate, remember exactly what Americans all over the country are fighting for.

Thomas Jefferson. Samuel Adams. Benjamin Franklin. John Hancock. These brave Americans had the sheer audacity to declare their independence from King George III. Facing isolation and probable death, they went forward with their plan to declare that they would be their own masters, rather than a single man in a distant capital.

They are rolling over in their graves now and are mad as Hell at “We the People” for letting this happen. Because 236 years ago, these Patriots declared that a long train of abuses committed against them would not be tolerated and would not happen again.

Obamacare is now official, which means that a lot more people in the United States will have health insurance. Sadly, it also means a lot more people will be paying more taxes.

Medicare billions going to Castro, Cuba

In a letter made public to Marilyn Tavenner, acting administrator of the Center for Medicare and Medicaid, senators Orrin Hatch, R-UT, and Tom Coburn, R-OK, were joined by Rep. Peter Roskam, R-IL, said they fear billions of tax dollars are being lost annually as a result.

“Clearly, the program vulnerabilities that facilitate billions of dollars to be stolen from the Medicare program each year also allow for some of that money to be funneled to foreign countries,” the three congressmen said.

“While the fraud itself is unacceptable, the loss of American dollars to foreign countries because of flaws in our system is totally unacceptable. One Metric on Impact: SWATting

 Last week I wrote about the Speedway Bomber and current left-wing activist Brett Kimberlin. In 2011, after writing about Kimberlin, LA County Prosecutor Patrick Frey, who blogs under the name Patterico, was rousted out of bed after midnight by the LA County SWAT Team. Someone had called 911 claiming to be Frey saying he’d just murdered his wife.

Sunday night as my family and sister’s family were around the dinner table and playing outside, sheriff’s deputies pulled into my driveway responding to an accidental shooting at my home.

One deputy was in the driveway. Another blocked the end of the driveway with his car. A neighbor tells me another was up the hill from the house.

There was no shooting at my home. Someone called 911, claimed to be at my home, and claimed to witness a shooting at my home.

As the one deputy and I spoke, the other deputy walked up the driveway, positioned himself behind the car in the driveway, and kept his eyes on me and his hand on his gun. My three year old ran between us all thinking it was so cool to have a police car in the driveway with its blue lights flashing.

Luckily, after I had starting writing about Kimberlin, I advised the Sheriff’s Department to be aware this could happen.

It was a prank, but not just any prank. This is a prank left-wing activists are increasingly deploying against those who dissent from their political views. When Barack Obama told his supporters in 2008 to bring guns to knife fights, some of his supporters took him a metaphorically than I assume he intended.

AMAC Tells Congress Social Security Reform is a No Brainer and Lawmakers Need to Act Now

BOHEMIA, NY, May 11 – The Association of Mature American Citizens is counting Congressional noses in order to determine the feasibility of passage for a “realistic, immediate” Social Security fix before the November elections.

Texas Voter ID Law Blocked by U.S. Justice Department as Biased

The Obama administration blocked Texas’s new law requiring voters to show government-issued photo identification at the polls, escalating a partisan dispute over voting restrictions.

The U.S. Justice Department is using its power under the Voting Rights Act to halt the Texas law, saying in a letter to the state today that the measure may disproportionately harm Hispanics. The department in December blocked a similar law in South Carolina.

Voter identification laws were passed last year in eight states. Whether the requirements are inconveniences or barriers to voting is at the core of a debate between Republican supporters who say the laws will protect election integrity, and Democrats who oppose the statutes as attempts to disenfranchise minorities and the poor.

“Even using the data most favorable to the state, Hispanics disproportionately lack either a driver’s license or a personal identification card,” Thomas Perez, head of the Justice Department’s civil rights division, wrote in the letter to Keith Ingram, the director of elections for the Texas Secretary of State.

A prosecutor has decided to pursue and possibly charge members of El Paso area churches who promoted petitions opposing the city administration’s decision to implement benefits for same-sex partners even after voters decided not to allow that.

The result is an emergency appeal to the state Supreme Court by attorneys with the Alliance Defense Fund, which has been working on the freedom of speech dispute.

Obama to cut healthcare benefits for active duty and retired US military

The Obama administration’s proposed defense budget calls for military families and retirees to pay sharply more for their healthcare, while leaving unionized civilian defense workers’ benefits untouched. The proposal is causing a major rift within the Pentagon, according to U.S. officials. Several congressional aides suggested the move is designed to increase the enrollment in Obamacare’s state-run insurance exchanges.

The disparity in treatment between civilian and uniformed personnel is causing a backlash within the military that could undermine recruitment and retention.

The proposed increases in health care payments by service members, which must be approved by Congress, are part of the Pentagon’s $487 billion cut in spending. It seeks to save $1.8 billion from the Tricare medical system in the fiscal 2013 budget, and $12.9 billion by 2017.

Many in Congress are opposing the proposed changes, which would require the passage of new legislation before being put in place.

“We shouldn’t ask our military to pay our bills when we aren’t willing to impose a similar hardship on the rest of the population,” Rep. Oversight Hearing Will Examine CFPB Director Richard Cordray

As you may know, Randy Neugebauer is the Chairman of the Financial Services Subcommittee on Oversight and Investigations. On Wednesday, Mr. Richard Cordray, who was recently appointed director of the Consumer Financial Protection Bureau (CFPB) by President Obama, will appear before my committee to testify on the CFPB’s budget. The CFPB currently enjoys unprecedented access to funding through the Federal Reserve Bank and can draw as much as $548 million from the Federal Reserve’s budget. There is no law, committee or person with the authority to prevent funds from being paid to the CFPB. These are funds that could otherwise be going to pay down the national debt.

This hearing will examine the CFPB’s budget to ensure that it is using public funds in a cost-effective and transparent way. They will also examine the CFPB’s policies and procedures for providing budget information to Congress. It is certainly no surprise for gun owners to see the New York Times run a story belittling the United States Constitution. After all, the Times has worked for decades to devalue our founding document.

“[I]ts influence is waning,” opines the Times. It is “terse and old, and it guarantees relatively few rights.” The paper faults the Constitution for being difficult to amend and reflective of the times in which it was written. While the Times does not go so far as to claim the U.S. Constitution has been bad for America, it does lament that it is of “little current use to, say, a new African nation.”

 But it was a much bigger shock when the Times reported in the same story that Ruth Bader Ginsburg, a sitting associate justice of the U.S. Supreme Court and grande dame of the Court’s liberal voting bloc, shares the Times’ dim view of the Constitution. Ginsburg said “I would not look to the United States Constitution if I were drafting a constitution in the year 2012.”  Her personal recommendations would instead include “the South African Constitution, the Canadian Charter of Rights and Freedoms and the European Convention on Human Rights.”

Rep. Stearns Cosponsors Chairman Smith’s Legal Workforce Act

Rep. Cliff Stearns (R-Fla.) has cosponsored Chairman Lamar Smith's Legal Workforce Act (H.R.2885) that would require 100% of businesses to use E-Verify within two years. The bill also requires all federal, state, and local governments to E-Verify their entire workforce.

Rep.Stearns  is serving his 12th term in Congress and represents Florida's 6th Congressional District and has earned a career A-plus grade. This Congress, Rep. Stearns has also cosponsored Rep. Steve King's bill to end Birthright Citizenship.

Chairman Smith's bill would:

Sheriff Joe Arpaio is being victimized by the U.S. Department of Justice (DOJ) under Attorney General Eric Holder. The politically motivated retaliation alleges that Arpaio and his department have engaged in willful civil rights violations: that his office racially profiles Latinos; bases immigration enforcement on racially charged citizen complaints; and punishes Hispanic jail inmates for speaking Spanish.

The Obama-controlled media and other far-left organizations are also piling on – in a blatant smear campaign against the ultra-Conservative Sheriff.

Holder continues to deny any foreknowledge of Fast and Furious

On Thursday, February 2, U.S. Attorney General Eric Holder testified before the House Oversight and Government Reform Committee regarding his role in the Bureau of Alcohol, Tobacco, Firearms and Explosives' gun running operation known as “Fast and Furious.”

During the hearing, Holder continued to deny any foreknowledge of the botched operation.  Representative Darrell Issa (R-Calif.), chairman of the House committee, led the charge in questioning Holder on his involvement and knowledge.  When Issa asked Holder if he had been briefed on the wiretaps presented in this case, Holder responded, "These wiretaps are very voluminous, read well kinds of things.  I have not read them." 

The U.S. Attorney General has an obligation to the American people to know what is going on under his watch, but throughout the hearing Holder continuously tried to distance himself from the activities of his staff. 

At one point during the hearing, Rep. Patrick McHenry (R-N.C.) told Holder, "You've not taken action, you've not fired anybody, you haven't changed policy, because it's clear you didn't enforce the policy before." 

Holder responded, "I've made personnel changes with regard to leadership positions.  We have moved people around.  We have instituted a series of policies now that I think are designed to make sure that doesn't happen again."

Limbaugh and Mike Reagan Blast Romney for Smears on Gingrich

On January 26, 2012, Ronald Reagan’s eldest son Mike Reagan has issued a statement lambasting Mitt Romney and his supporters for claims that Romney’s Republican presidential rival Newt Gingrich was a strong critic of President Reagan.

Mike Reagan says such claims are false.

Even Rush Limbaugh, shocked by the Romney claims, chimed on his Thursday radio broadcast to say, "This is obviously a coordinated attack to take Newt out here in Florida."

Senator Inhofe Rips “Reckless” Obama Over Pipeline

Oklahoma Sen. Jim Inhofe, the ranking Republican on the Senate Environment and Public Works Committee, has blasted President Barack Obama for siding with “radical” environmentalists and shelving plans for the Keystone XL pipeline.

The 1,700-mile pipeline would have brought oil from Canada to refineries in Texas, created thousands of jobs, and lessened America’s reliance on Middle East oil. Environmentalists claimed it posed the threat of an oil leak.

EPA Threatens North Dakota Oil Boom

Oil production in North Dakota has boomed to the point that the state now produces nearly as much oil each day as OPEC member Ecuador.

But a decision by the Environmental Protection Agency (EPA) could bring a halt to the boom that has virtually eliminated unemployment in North Dakota.

The state now has 200 rigs pumping 440,000 barrels of oil daily in the Bakken shale formation, according to the Heartland Institute. The state’s unemployment rate is holding at just 3.5 percent, with many oil industry jobs paying more than $100,000 a year, and “we have 18,000 jobs looking for people,” North Dakota Republican Rep. Rick Berg told The Hill.

“If our country’s GDP grew at 7 percent, as it does in [my] state, most of our problems would be over in two years.”

Senate in party line vote rejects measure to overturn FCC net neutrality rules

The Senate rejected a bid to overturn the Federal Communications Commission's controversial net neutrality rules on Thursday in a party-line vote.

The measure passed the House in April, but failed in the Senate on a vote of 52 to 46. It needed 51 votes to pass and was not subject to a filibuster. The White House threatened earlier this week to veto the measure if it cleared the Senate, which came as no surprise since President Obama made net neutrality part of his campaign platform.

CAIN CLARIFIES ABORTION STATEMENT

On the Piers Morgan’s show on CNN, Herman Cain seemingly took the position that while he is pro-life and thinks abortion is wrong, he would not as President do anything to stop women from having abortions. Later he tries to clarify what he meant.

“Yesterday in an interview with Piers Morgan on CNN, I was asked questions about abortion policy and the role of the President.

I understood the thrust of the question to ask whether that I, as president, would simply “order” people to not seek an abortion.

My answer was focused on the role of the President. The President has no constitutional authority to order any such action by anyone. That was the point I was trying to convey.

As to my political policy view on abortion, I am 100% pro-life. End of story.

I will appoint judges who understand the original intent of the Constitution. Judges who are committed to the rule of law know that the Constitution contains no right to take the life of unborn children.

I will oppose government funding of abortion. I will veto any legislation that contains funds for Planned Parenthood. I will do everything that a President can do, consistent with his constitutional role, to advance the culture of life.”

MORGAN: By expressing the view that you expressed, you are effectively — you might be president. You can’t hide behind now the mask, if you don’t mind me saying, of being the pizza guy. You might be the president of United States of America. So your views on these things become exponentially massively more important. They become a directive to the nation.

CAIN: No they don’t. I can have an opinion on an issue without it being a directive on the nation. The government shouldn’t be trying to tell people everything to do, especially when it comes to social decisions that they need to make.

Clearly Herman Cain is personally pro-life, but he does not favor government intervention in the matter. His statement seems to put this all to rest, but Pro-lifers who are as yet uncommitted in this race want clarity on the subject above all else. Sen’s Hutchison, Cornyn Urge White House to Approve States Amended Federal Disaster Declaration

WASHINGTON— U.S. Sens. Kay Bailey Hutchison and John Cornyn (R-Texas) yesterday sent the following letter to President Barack Obama urging him to approve Gov. Rick Perry’s request for an amended Federal Disaster Declaration to include additional counties and provide support for wildfire debris removal and rebuilding.

More than 19,000 fires have burned over 3.5 million acres of land in Texas in 2011, according to the Texas Forest Service, and have caused at least four deaths.  In May, President Obama declined an invitation from Senators Hutchison and Cornyn to tour areas of Texas devastated by wildfires.  Read the full text of the letter.

Federal Judge Rejects New York Gun Law Challenge

A Federal judge in New York has upheld the State’s law concerning an individual having to show a necessity for self-protection in order to obtain a license to carry a handgun, The Associated Press reported.

District Judge Cathy Seibel ruled against the challenge to the State law because of an alleged important government interest in preventing crime. While leaders on the left applauded the ruling, Alan Gura, the attorney for the plaintiff, noted that an appeal would be filed, according to the news outlet.

She said the state's gun law fell within the limits set by Heller, did not violate the Second Amendment right to bear arms, and could thus not be widened as the plaintiffs wanted.

"As crafted, the statute seeks to limit the use of handguns to self-defensive purposes a use which, although in this context existing outside the home, is nonetheless a hallmark of Heller rather than for some other use that has not been recognized as falling within the protections of the Second Amendment," said Seibel, who sits in White Plains.

“The question here is whether the government gets to regulate a constitutional right or completely abolish it,” Gura said.

The five plaintiffs from Westchester County brought the suit in an effort to freeze the “proper cause” element in the permit-application process, something that they argued was a direct violation of their 2nd Amendment rights, Reuters reported.

Gura noted that they might take the case as high as the Supreme Court, as the plaintiffs argued that the threat of significant random violence is all too prevalent in New York City, reported the AP.

They sued the county and the county judges who had turned down the applications. They argued that under recent Supreme Court decisions involving gun control measures in Chicago and Washington, D.C., New York's restriction was unconstitutional.

The plaintiffs, in their rejected applications, had cited reasons including the threat of random violence, the desire to get involved in competitive shooting and being "a transgender female subject to a higher likelihood of violence," the judge said.

House Leaders Request President Obama’s Proposed Legislation

House Speaker John Boehner (R-OH), Majority Leader Eric Cantor (R-VA), Majority Whip Kevin McCarthy (R-CA), and Republican Conference Chairman Jeb Hensarling (R-TX) sent the following letter to the White House today requesting the text of the legislation proposed by President Obama in his address to Congress. California Passes Bill Barring Local E-Verify Mandate

The California State Senate passed A.B.1236 earlier this week, sending the bill to Gov. Jerry Brown for his signature. The bill would prohibit counties and local municipalities in the state from requiring businesses to use E-Verify, furthering the need for House Judiciary Chairman Lamar Smith's Legal Workforce Act that would require all business in the U.S. to use E-Verify.

“California has the second highest unemployment rate in the U.S., yet elected officials in Sacramento just sent a bill to the Governor’s desk that will further diminish job opportunities," Chairman Smith said. "California’s E-Verify opt-out bill shows exactly why we need a federal E-Verify law.  Without a federal law on the books, some states—including those with the largest illegal immigrant populations, such as California—will be free to hire illegal workers.

“That’s why I have introduced the Legal Workforce Act," he added. "This bill requires all U.S. employers to use E-Verify to check whether prospective employees are legally authorized to work in the U.S.  This program is free, quick and easy to use – those eligible to work are immediately confirmed 99.5% of the time. This bill is one of the most significant steps we can take to put millions of Americans back to work and curb incentives that drive illegal immigration.”

“Illegal immigration cost Californians a net of more than $20 billion in 2010 in services and incarceration costs," California Representative and House Immigration Subcommittee Chairman Elton Gallegly said. "Yet California continues to provide magnets to draw illegal immigrants to the state. That includes free education for illegal immigrant adults, sanctuary cities and – soon – an opt-out for E-Verify.

“Illegal immigration will not subside until we remove the magnets, including the largest one, a job," Gallegly added. "California’s bill to prohibit cities and counties from requiring employers to use E-Verify is one of the reasons I am working with House Judiciary Committee Chairman Lamar Smith of Texas to pass a federal law to make it mandatory for all employers in the United States. It has a 98 percent accuracy rate, which is far better than the antiquated I-9 forms now used.”

In June, Chairman Smith introduced the Legal Workforce Act (H.R. 2164). Chairman Gallegly is an original cosponsor.  This bill could open up millions of jobs for unemployed Americans by requiring all U.S. employers to use E-Verify.

A federal E-Verify law for all U.S. employers is essential to protecting jobs for American workers and reducing the jobs magnet that encourages illegal immigration.  Only 17 out of the 50 states and the District of Columbia have an E-Verify mandate in place. And unfortunately, these state laws are only applied in a limited way or are rarely enforced. 

Texas Employee Parking Lot Protection Bill Takes Effect September 1!

NRA-backed Senate Bill 321 takes effect this Thursday, September 1.  This measure, authored by state Senator Glenn Hegar (R-Katy) & state Representative Tim Kleinschmidt (R-Lexington), and signed into law by Governor Rick Perry, prohibits most employers from enacting and enforcing bans on employees transporting and storing firearms in their locked, private motor vehicles while parked at work.  This important new law recognizes that hard-working Texans' right to self-defense does not end when they drive onto their employers property, and it honors the strong sporting culture of the Lone Star State where employees often hunt or visit the local gun club before or after work. 

SB 321 applies to both public and private employers, as well as all lawfully-owned firearms - not just firearms in the possession of Concealed Handgun Licensees.  However, SB 321 does not authorize an employee to possess firearms on any property where such possession is prohibited by state or federal law, and the provisions of the bill do not apply to the following:

  • Vehicles owned or leased by the employer and used by the employee for work purposes;
  • School districts, open enrollment charter schools, and private schools as defined in Section 22.081, Education Code;
  • Property owned or controlled by a person, other than an employer, that is subject to a valid, unexpired oil, gas, or other mineral lease that contains a provision prohibiting the possession of firearms on the property; or
  • Property owned or leased by a chemical manufacturer or oil and gas refiner permitted by TCEQ and on which the primary business conducted is the manufacture, use, storage or transportation of hazardous, combustible, or explosive materials; however, employees at  these facilities who are CHLs may store firearms (including rifles or shotguns) in their private motor vehicles in parking areas located outside of secured and restricted areas which contain the physical plant, are not open to the public and which are constantly monitored by security personnel.
Gov’t says wood is illegal if U. S. workers produce it

The Justice department bullies Gibson without filing charges

The Federal Department of Justice in Washington, D.C. has suggested that the use of wood from India that is not finished by Indian workers is illegal, not because of U.S. law, but because it is the Justice Department’s interpretation of a law in India. (If the same wood from the same tree was finished by Indian workers, the material would be legal.) This action was taken without the support and consent of the government in India.

On August 24, 2011, around 8:45 a.m. CDT, agents for the federal government executed four search warrants on Gibson’s facilities in Nashville and Memphis and seized several pallets of wood, electronic files and guitars. Gibson had to cease its manufacturing operations and send workers home for the day, while armed agents executed the search warrants. Gibson has fully cooperated with the execution of the search warrants.

• Raid shut down Gibson factories and cost company money
This is the second time that federal agents have raided Gibson facilities and disrupted production – this time causing lost productivity and sales.

• Wood seized was Forest Stewardship Council Controlled
The wood the Government seized on August 24 is from a Forest Stewardship Council certified supplier and is FSC Controlled, meaning that the wood complies with the standards of the Forest Stewardship Council, which is an industry-recognized and independent, not-for-profit organization established to promote responsible management of the world’s forests. FSC Controlled Wood standards require, among other things, that the wood not be illegally harvested and not be harvested in violation of traditional and civil rights. Gibson has a long history of supporting sustainable and responsible sources of wood and has worked diligently with entities such as the Rainforest Alliance and Greenpeace to secure FSC certified supplies. The wood seized on August 24 satisfied FSC standards.

• Nearly two years later, no charges have been filed
In 2009, more than a dozen agents with automatic weapons invaded the Gibson factory in Nashville. The Government seized guitars and a substantial amount of ebony fingerboard blanks from Madagascar. To date, 1 year and 9 months later, criminal charges have NOT been filed, yet the Government still holds Gibson’s property. Gibson has obtained sworn statements and documents from the Madagascar government and these materials, which have been filed in federal court, show that the wood seized in 2009 was legally exported under Madagascar law and that no law has been violated. Gibson is attempting to have its property returned in a civil proceeding that is pending in federal court.

The Justice Department has asked the judge to stop the court case indefinitely.

• Information sought in raid was already made available
Since 2009, Gibson has fully cooperated with the Government’s investigation of wood and has provided substantial documentation regarding Gibson’s wood-buying activities over the years. Yet, the Federal Government raided Gibson’s facilities on August 24, 2011, without warning or communication of any kind. Had the Government simply communicated with Gibson, Gibson would have cooperated without having to stop its production and send workers home.

• Not about illegal logging, not about conservation, not about the environment
The U.S. Lacey Act does not directly address conservation issues but is about obeying all laws of the countries from which wood products are procured. This law reads that you are guilty if you did not observe a law even though you had no knowledge of that law in a foreign country. The U.S. Lacey Act is only applicable when a foreign law has been violated.

• Gibson is innocent and will fight to protect its rights
Gibson has complied with foreign laws and believes it is innocent of ANY wrong doing. We will fight aggressively to prove our innocence.

Social Security disability on verge of insolvency

According to AP news reports laid-off workers and aging baby boomers are flooding Social Security's disability program with benefit claims, pushing the financially strapped system toward the brink of insolvency. 

Applications are up nearly 50 percent over a decade ago as people with disabilities lose their jobs and can't find new ones in an economy that has shed nearly 7 million jobs. The stampede for benefits is adding to a growing backlog of applicants many wait two years or more before their cases are resolved and worsening the financial problems of a program that's been running in the red for years. 

New congressional estimates say the trust fund that supports Social Security disability will run out of money by 2017, leaving the program unable to pay full benefits, unless Congress acts. About two decades later, Social Security's much larger retirement fund is projected to run dry as well. Much of the focus in Washington has been on fixing Social Security's retirement system. Proposals range from raising the retirement age to means-testing benefits for wealthy retirees. But the disability system is in much worse shape and its problems defy easy solutions.

 The trustees who oversee Social Security are urging Congress to shore up the disability system by reallocating money from the retirement program, just as lawmakers did in 1994. That, however, would provide only short-term relief at the expense of weakening the retirement program. Claims for disability benefits typically increase in a bad economy because many disabled people get laid off and can't find a new job. This year, about 3.3 million people are expected to apply for federal disability benefits. That's 700,000 more than in 2008 and 1 million more than a decade ago.

 "It's primarily economic desperation," Social Security Commissioner Michael Astrue said in an interview. "People on the margins who get bad news in terms of a layoff and have no other place to go and they take a shot at disability."

Illegal Aliens Will Receive Work Permits

According to a Wall Street Journal report, illegal aliens will be eligible to receive work permits if their deportation is deferred through the Obama Administration's new policy. On August 19, 2011, the Administration announced that the Department of Homeland Security will review all deportation cases on a case-by-case basis and only deport illegal aliens who have been convicted of crimes.

The Administration has come under scrutiny from pro-amnesty groups for its record number of deportations, despite its policy of focusing on only criminal illegal aliens. Still, half of last year's 400,000 deported illegal aliens had not been convicted of a crime other than entering the country illegally. But several states, including Georgia, Alabama, South Carolina, and Arizona, have increased efforts to arrest individuals in the country illegally.

"The Obama administration should enforce immigration laws, not look for ways to ignore them," said Rep. Lamar Smith (R., Texas), head of the House Judiciary Committee.

Illegal aliens living in the United States typically don't apply for work permits for fear of deportation, but under the new policy, they could apply for work permits if granted deferred action or parole and compete with 22 million Americans who can't find a full-time job.

GOVERNMENT vs ORGANIC FOOD PRODUCERS

Back on May 1, 2011 a year long sting operation, including aliases, a 5 a.m. surprise inspection and surreptitious purchases from an Amish farm in Pennsylvania, culminated in the federal government announcing this week that it has gone to court to stop Rainbow Acres Farm from selling its contraband to willing customers in the Washington area.

The product in question: unpasteurized milk.

It's a battle that's been going on behind the scenes for years, with natural foods advocates arguing that raw milk, as it's also known, is healthier than the pasteurized product, while the Food and Drug Administration says raw milk can carry harmful bacteria such as salmonella, E. coli and listeria.

A Great Texas Senator Announces Her Retirement in 2012

U.S. Senator Kay Bailey Hutchinson announced last Thursday that she will not run for re-election in 2012. Texas has been blessed with many great Senators and I consider Senator Hutchinson to be one of the best. She and her staff have worked long hours to help the Lone Star State, and I always value her advice and counsel while performing my duties representing the people of the 19th District. I know all Texans join me in wishing her well with her future endeavors.

But Craig Parshall, who oversees the communications and media efforts of NRB, does not foresee the system reaping positive effects.

Giffords making small movements on her own

Four days after being shot in the head, U.S. Rep. Gabrielle Giffords was making small movements on her own, tugging at her hospital gown and touching her wounds, one of her doctors said Wednesday.

Giffords remained in critical condition at Tucson's University Medical Center after she was struck once in the head Saturday. Authorities accuse Jared Loughner, 22, of opening fire on a crowd at an event she was holding. Nineteen people were shot and six died. Read More

The Food Safety Saga

The FDA Food Safety Modernization Act had more twists and turns than a big-city sewer system.  Unexpected passage of the legislation at the very end of the lame duck Congress does not bring the story to a close. The fight goes on.

Regulations will need to be developed, which the FDA will try to do out of sight, but which we will monitor closely. The FDA will need funding to do the work, which means more legislation. And there may be other legislative opportunities to help pull back this seeming victory for agribusiness, factory faming, and its allies in Washington.

We have to keep educating Capitol Hill about the dangers of CAFOs, the main source of food contamination, and about the benefits—both to our health and our economy—of small farmers and especially local organic farmers. We need, in short, to keep the government from destroying what’s best about agriculture in this country. Big Food may have won this round, but they have most certainly not won the war.

Before we turn to the future, it’s also worth reviewing the story of what actually happened with this legislation. There has been a great deal of confusion about what took place, and it’s important to set the record straight. We also need to remember that natural health and family farming won some concessions along  the way, concessions that kept this legislation from being far, far worse than it is. All of these concessions were won by a broad coalition of tireless health freedom advocates, while some of them-especially in the areas of potential CODEX regulation and supplements-were won specifically by ANH-USA, and we’re proud of those accomplishments. NASA Must Fund Canceled Rocket Program

NASA's Ares I rocket program is defunct but because of congressional inaction the space agency must continue to fund it until March, officials said.

The requirement will cost NASA almost $500 million as the agency battles with the costly task of replacing the space shuttle program, the Orlando (Fla.) Sentinel reported Sunday.

About $165 million will go to Alliant Techsystems as part of a $2 billion contract to build a solid-fuel first stage for the Ares, which was supposed to be part of the Constellation program to fill the space shuttle's role of launching astronauts to the International Space Station.

The money to Alliant is part of what NASA will spend on the canceled program from Oct. 1 through March.

Most of the rest will go to Lockheed Martin, which is building the Orion capsule intended to take astronauts into space aboard whatever rocket NASA ultimately builds.

The federal government's 2010 budget contains language that barred NASA from shutting down the Ares program until Congress passed a 2011 budget.

That should have been done before the Oct. 1 start of the federal fiscal year but Congress was unable to pass a 2011 budget and instead voted this month to extend the 2010 budget until March -- meaning NASA still must abide by the 2010 language.

So NASA and its contractors are required to keep building Ares I, even though President Obama effectively killed it when he signed the new NASA plan that canceled the Constellation program begun under President George W. Bush.

Is the DREAM ACT Dead

Now that the dream act has been voted down we can get to other business at hand or can we?  The Dream Act in name only has been voted down but there are other bills that will be on the agenda of the Progressives. We must watch for these back door bills; we must make sure that the Dream Act is put out of our misery once and for all. The new congress said that they would be against “Ear Marks” in any bill. WE THE PEOPLE must keep them to there word. Here are some other bills that are laying in wait: DREAM Act S.3962, S.3963, H.R.5281, H.R.6327, H.R.6497. Watch for these bills and tell your elected officials that you are against these bills. They are still active and could and will be brought up for vote this coming session.

Individual Mandate Unconstitutional: Government Doesn’t Know Best

From the start, the people around the nation did not want a government takeover of health care. Almost nine months later, a federal judge in Virginia confirmed that portions of the law are also unconstitutional. The ruling found that the individual mandate – the piece of the new health care law that requires individuals to purchase health insurance – is unconstitutional and oversteps the authority of Congress. This is just further proof that Washington cannot dictate your personal health care decisions.

The health care law expands the power and scope of the federal government. It contains the first ever federal mandate to require individuals to purchase health insurance. The federal government should not have the authority to force Americans to buy health insurance they do not want. The bottom line is that this new health care law is severely misguided. While the Supreme Court has the final say on this decision, I am encouraged by today’s findings in favor of individual rights.

This is just one battle, the war has just begun. But it was an important battle to win.  All the states Attorney Generals need our support. They’re fighting this war for the freedom of all Americans. If the Obamacare don’t get nullified We The People won’t recognize this country as we know it now. So keep telling your Representatives that you don’t want Obamacare. Food Safety Bill Language Has Been Resurrected

On December 8, the House of Representatives passed a Continuing Resolution (CR) H.R.3082. A CR is supposed to provide temporary, stopgap funding for the government while budget bills are worked out.  But this CR included the language of the Senate food safety bill—language that will still affect small food producers (organic farms, small farms, mom-and-pop roadside stands, etc.) most of all. Amtrak Prepares For Guns In Checked Bags

Railroad passengers on Amtrak should soon be able to once again transport firearms in checked baggage.  The change is slated to begin on Dec. 15, the effective date of the amendment by Sen. Roger Wicker, R-Miss., that forced Amtrak to accommodate gun owners.  The new service will only be available between stations where checked baggage service is currently available.             Read more

Sen. Sessions Urges Fellow Senators to Oppose the DREAM Act

IRS Set to Begin Monitoring Internet Transactions

Inserted directly into the housing bailout package signed by President George W. Bush was a provision requiring that records of merchant credit card transactions be sent directly to the IRS. “In the past, when IRS wanted to get information from banks and merchant accounts, it required going to a judge and getting a subpoena,” notes IRS enrolled taxpayer representative Eva Rosenberg. “With this new law in place, IRS can now step in and audit at any time – with little or no notice.”  READ FULL ARTICLE
